Acceptable User Policy

This Acceptable Use Policy (“AUP”) outlines the rules and guidelines for using the services provided by Atfenix Data Centre Private Limited (“Atfenix,” “we,” “our,” or “us”). By using our services, you (“Customer,” “you,” or “your”) agree to comply with this AUP in addition to our Terms of Service (ToS). The purpose of this AUP is to ensure secure, lawful, and reliable use of Atfenix’s infrastructure, including colocation, dedicated servers, VPS, cloud, and network services.

1. Prohibited Activities

Customers shall not use Atfenix services for activities that are illegal, harmful, or disruptive, including but not limited to:

A. Illegal Use

Hosting, transmitting, or distributing content in violation of applicable laws (local, national, or international).
Engaging in activities related to child exploitation, human trafficking, terrorism, or other unlawful content.

B. Security Violations

Unauthorized access, scanning, or probing of networks, systems, or accounts without permission.
Distributing viruses, malware, ransomware, trojans, or any harmful code.
Launching or participating in DDoS attacks, botnets, or brute-force attempts.

C. Network Abuse

Overloading or disrupting Atfenix’s network or other connected networks.
Sending excessive traffic, spamming, or using services for unsolicited bulk email (UBE) or unsolicited commercial email (UCE).
Running open mail relays or anonymizers designed to conceal illegal activity.

D. Intellectual Property Violations

Hosting or distributing pirated software, counterfeit products, or copyrighted material without authorization.
Infringing on trademarks, patents, or proprietary content.

E. Prohibited Content & Activities

Hosting or distributing obscene, defamatory, or abusive content.
Running gambling, phishing, scam, or fraudulent websites.
Hosting cryptocurrency mining operations unless expressly authorized by Atfenix.
Engaging in any activity that could damage Atfenix’s reputation or affect other customers.

2. Customer Responsibilities

Customers are solely responsible for the content hosted and the actions performed through their accounts.
Customers must maintain secure passwords, access controls, and regular updates on hosted systems.
Customers must comply with all data protection and privacy laws applicable to their region.
Customers shall promptly report any security breaches, vulnerabilities, or abuse to Atfenix.

3. Fair Usage Policy

To ensure equitable access to Atfenix resources:

Excessive consumption of bandwidth, power, or compute resources that adversely affects other customers is prohibited.
Atfenix may throttle, suspend, or terminate services if a customer’s usage disrupts normal operations.

4. Enforcement & Consequences

Violations of this AUP may result in the following actions, at Atfenix’s sole discretion:

Warning notice to the customer.
Temporary suspension of services.
Permanent termination of services.
Referral to law enforcement authorities (if required).

Note: Atfenix reserves the right to investigate suspected violations and access, preserve, or disclose information as required by law or to protect its infrastructure.

5. Reporting Abuse

Relevant logs, screenshots, or evidence.

Changes to the AUP

Atfenix reserves the right to update this Acceptable Use Policy at any time. Updates will be posted on www.atfenix.com, and continued use of services after updates constitutes acceptance.

Governing Law

This AUP shall be governed by the laws of India, with jurisdiction in Noida, Uttar Pradesh.
